In 2009 the Centers for Medicare & Medicaid Services (CMS) ruled that certain DMEPOS Suppliers must obtain and maintain a DMEPOS Surety bond in order to participate in the program. The ruling requires that a minimum surety bond of $50,000.00 must be provided for each location and allows for the CMS to require a larger bond amount for licensees that are currently or have been out of compliance in the past. All suppliers enrolled with the National Supplier Clearing house (NSC) you must provide and maintain a DMEPOS Surety Bond.
Pharmacies that are enrolled as DMEPOS suppliers and bill DME MAC for non-accredited products are also required to obtain and maintain a DMEPOS Surety Bond.
