Surety Bonds 101 - Bail & Immigration Bonds

  • A bail bond is one method used to obtain the release of a defendant awaiting trial upon criminal charges from the custody of law enforcement officials. The defendant, the defendant's family and friends, or a professional bail bond agent executes a document that promises to forfeit the sum of money determined by the court to be commensurate with the gravity of the alleged offense if the defendant fails to return for the trial date. This document is usually backed by a Surety Company.
  • An Immigration bond issued by a Surety company not only guarantees the detainees appearance but also guarantees that the Alien will not become a burden on the state. In other words if a detainee on bond gets injured crossing the street and is taken to the local county hospital for treatment all costs incurred by the county, city or state can be passed on to the Surety company that issued the original bond on the alien.
